Abstract

The article consists in the study of the jurisprudence regarding the termination of employment contract on the grounds of a serious non-compliance of the contractual obligations undertaken by the employee (article 160 N° 7 Labor Code). Specifically, we refer to the understanding of the monetary damages as a requisite for the configuration of the seriousness of the breach of the obligations by the employee. The determination of the seriousness corresponds to a reasoning that has originated contradictory jurisprudence in similar circumstances. We review the different aspects that have been considered in that reasoning and the circumstances that have caused the different criteria. Finally, we include the conclusions of the study and a proposal to reduce the differences seen in the jurisprudence.
